Terms of Service
Last updated October 31, 2026
1. The agreement
These terms are an agreement between Data Visions Inc. (“Data Visions”, “we”, “us”) and the organization that signs up for or uses our services (“you”). They cover the Data Visions platform and its workspaces, modules and AI features, the connector for AI assistants, the website datavisions.ai, and professional services we perform for you.
The person accepting these terms confirms they may do so for their organization. If we sign an order form or statement of work with you, it is part of this agreement and wins where it differs from these terms. Our Privacy Policy explains how we handle personal information.
2. Your workspace and users
Your organization gets a workspace. Its administrators decide who can use it and what each person can do, and are responsible for their users' activity and for keeping sign-in details safe. Tell us promptly at support@datavisions.ai if you think an account has been misused.
3. Prices and billing
- What you pay for: your plan, plus what you use: AI on keys Data Visions provides, hosting, storage, compute, websites, marketplace modules and other services you turn on. Current prices and your usage are shown in your workspace under System Settings > Billing.
- When: each month is charged on the 1st of the following month, to the card or US bank account your organization keeps on file. Payments are processed by Stripe, which emails the invoice and receipt.
- Professional services (setup, custom development, training and similar work) are priced in a quote or statement of work and invoiced when delivered, or as the quote says.
- Taxes: prices do not include sales or similar taxes, which are added where the law requires.
- Questions about a charge: tell us within 30 days of the invoice and we will look at it in good faith. Disputing a correct charge with your bank instead may pause your workspace as described in Section 4.
- Price changes: we give workspace administrators at least 30 days' notice before a price increase takes effect.
4. Payment method and pausing a workspace
A workspace that must pay keeps a working payment method on file. If there is none, or a payment fails, its administrators see a notice and the workspace keeps working for 14 days. If it is still not fixed after that, the workspace is paused: people can still sign in and update the payment method, but cannot otherwise use it until it is fixed. Pausing does not delete your data, and everything resumes as soon as payment goes through.
5. AI features
- Providers. AI features use models from Anthropic, Google, OpenAI and xAI. The Privacy Policy lists what each provider receives.
- Check AI output. AI output can be wrong, incomplete or out of date. Do not rely on facts it states without checking them, especially for legal, financial, medical, safety or compliance matters.
- Decisions about people. If you use AI to help make decisions that significantly affect people, such as hiring, pay, credit, housing or legal and health matters, a qualified person must review each decision, and you must tell the people affected that AI was involved where the law or the AI provider's policy requires it. Data Visions is not intended for medical or clinical use.
- Who owns the output. Between you and us, you own the AI output generated for you. Because of how AI works, other customers may receive similar output.
- No training on your content. We do not use your content or AI conversations to train AI models, and our AI providers' business terms do not allow them to either.
- Provider policies. You and your users must follow the usage policies of the AI providers whose models you use: Anthropic, Google, OpenAI and xAI. You are responsible for your users' use of AI through your workspace.
- How AI use is charged. A plan may include a monthly amount of AI use; use beyond it is charged as used, based on our usage records, whether or not the output is what you wanted. Where your administrators turn on a limit, AI pauses when the month's amount is used until more is added. Questions about a charge follow Section 3.
- Your own AI keys. If your organization uses its own AI keys, the provider bills you for that use directly, and that provider's terms apply to it.
6. Your data
You own the information you and your users put into Data Visions (“your data”). You give us permission to store, process and transmit it only to provide, secure and support the services for you, as described in the Privacy Policy. You are responsible for having the right to put your data into the service.
You can export your data while your subscription is active. When your subscription ends, your workspace is switched off for 30 days, during which you can ask for an export, and is then deleted.
7. Acceptable use
You agree not to use the services to:
- break the law, infringe others' rights, or store or send content you have no right to;
- send spam or malware, or try to get into accounts, workspaces or systems that are not yours;
- overload, probe or interfere with the services, or get around their limits or security;
- copy or resell the platform itself, or use it to build a competing service;
- use AI output to develop or train AI models that compete with Data Visions or its AI providers, or get around the safety features of any AI model.
The services are for people 18 and older.
We may suspend access that breaks these rules or puts the service or other customers at risk, and will tell you why unless the law or an emergency prevents it.
8. Modules, marketplace and other services
Modules published in the Data Visions marketplace by other organizations are provided by their publishers, who may set their own terms. Services you connect (for example email, maps, accounting or other business systems) are governed by their own terms, and we are not responsible for them.
9. Professional services and custom work
When we build custom software for you under a quote or statement of work, you own the source code we deliver once it is paid for. We keep ownership of the Data Visions platform, our tools and general know-how, and of anything we built before or apart from your project; you may use them as part of your deliverables for as long as you use those deliverables.
10. Our platform
Data Visions owns the platform, its software and its content, apart from your data. We give you the right to use the services during your subscription under these terms. If you send us feedback or suggestions, we may use them without obligation to you.
11. Confidentiality
Each of us will keep the other's non-public information confidential, use it only for this agreement, and share it only with people who need it and are bound to protect it.
12. Availability and changes
We work to keep the services available and secure, and we improve them over time, so features can change. Unless an order form gives a service level, the services are provided without a guaranteed uptime. Where we reasonably can, we give notice before removing a feature your organization depends on.
13. Term and cancellation
Subscriptions run month to month unless an order form says otherwise. You can cancel at any time; you pay for the month in which you cancel and for any work already delivered. We may end this agreement with 30 days' notice, or at once if you seriously break these terms. Sections 3 (for amounts owed), 6, 9, 10, 11, 14, 15 and 17 continue after it ends.
14. Disclaimer
Except as stated in these terms, the services are provided “as is”, and we disclaim all other warranties, including merchantability, fitness for a particular purpose and non-infringement, to the extent the law allows.
15. Limitation of liability
Neither of us is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data, even if warned of them. Each party's total liability under this agreement is limited to the amounts you paid us in the 12 months before the claim. These limits do not apply to your payment obligations, to breaches of Section 7, or where the law does not allow them.
16. Changes to these terms
We may update these terms. We will post the new version here with a new date and tell workspace administrators at least 30 days before a significant change takes effect. Continuing to use the services after that means you accept the change.
17. Law and contact
These terms are governed by the laws of the State of Utah, USA, and disputes go to the state and federal courts in Utah. Contact: Data Visions Inc., 2002 Stone Canyon Drive, St. George, Utah 84790, USA, support@datavisions.ai.
